1. Scope

These Terms and Conditions apply to all orders placed through our online store at createyourskate.com.

CreateYourSkate GmbH operates the brand CRESKATE under which our products are offered.

By placing an order in our online store, you agree to these Terms and Conditions.

2. Products and product descriptions

We sell fingerboard kits, tools, molds, accessories, veneer, ramps and related products for fingerboarding, DIY projects, creative work and educational use.

We make every effort to describe and display our products as accurately as possible. However, slight variations in colour, wood grain, surface finish, dimensions or appearance may occur, especially with natural materials such as wood veneer, handmade products and custom-made products.

Product images are for illustration purposes and may differ slightly from the actual product. Technical improvements, minor design updates or packaging changes may occur without affecting the essential characteristics or intended use of the product.

3. Custom-made products

Some of our products are custom-made according to the customer’s individual configuration.

This applies in particular to:

  • ExpertMold

  • ProMold

  • other products that are individually configured, personalised or manufactured according to customer specifications

For custom-made products, the customer is responsible for checking all selected dimensions, geometry, shape parameters, design options, technical specifications and other configuration details before placing the order.

Once production has started, custom-made products cannot be changed, cancelled, returned or exchanged due to a change of mind, dissatisfaction with the selected configuration or incorrect dimensions or parameters entered by the customer.

This does not affect your statutory rights if the product is defective, damaged, manufactured incorrectly or does not match the specifications confirmed in your order.

4. Conclusion of contract

The presentation of products in our online store does not constitute a legally binding offer, but an invitation to place an order.

By clicking the order button at checkout, you submit a binding offer to purchase the selected products.

After placing your order, you will receive an automatic order confirmation by email. This email confirms that we have received your order.

A purchase contract is concluded when we accept your order, either by sending an order confirmation, sending a shipping confirmation or dispatching the goods.

We reserve the right to refuse or cancel orders where there is a legitimate reason, for example if a product is unavailable, payment cannot be processed, there is an obvious pricing or product information error, delivery to the selected country is not possible, or there is suspected misuse or fraud.

5. Prices and payment

All prices shown in the online store are in the currency displayed at checkout and include applicable VAT where required, unless stated otherwise.

Shipping costs, customs duties, import taxes or other additional charges may apply depending on the delivery country and will be shown or explained where applicable.

Payment is made using the payment methods available at checkout, such as Shopify Payments, PayPal, credit card, Apple Pay or other available payment providers.

The available payment methods may vary depending on the delivery country and technical availability.

We reserve the right to exclude individual payment methods in specific cases where there is a legitimate reason.

6. Shipping and delivery

We ship to the countries shown in our online store.

Delivery times stated in the online store are estimates and may vary depending on destination, customs processing, carrier delays, seasonal volume, weather conditions or other circumstances outside our control.

For deliveries outside the European Union, import duties, customs fees, taxes, brokerage fees or other charges may apply. These charges are the responsibility of the customer and are not included in the product price or shipping costs unless expressly stated otherwise.

The customer is responsible for providing complete and accurate shipping information. If a parcel cannot be delivered due to incorrect or incomplete address information, refusal of acceptance, missing customs information or failure to collect the parcel, additional shipping costs may be charged.

If a shipment is returned to us because delivery was not possible for reasons attributable to the customer, we may charge the customer for the additional costs of return shipping and, where applicable, reshipping.

7. Retention of title

The goods remain our property until full payment has been received.

8. Right of withdrawal and returns

Consumers have a statutory right of withdrawal in accordance with our Right of Withdrawal & Returns Policy.

Please note that the statutory right of withdrawal does not apply to goods that are not prefabricated and are made on the basis of an individual choice or decision by the customer, or goods that are clearly tailored to the customer’s personal needs.

This applies in particular to custom-made products such as ExpertMold and ProMold.

9. Defects and statutory warranty rights

Your statutory warranty rights apply.

If a product is defective, damaged or does not match the specifications confirmed in your order, please contact us as soon as possible at dennis@createyourskate.com.

We may ask you to provide photos, a description of the issue and your order number so that we can evaluate the problem and find an appropriate solution.

Nothing in these Terms limits your statutory rights as a consumer.

10. Product use, safety and compliance

Our products are developed for fingerboarding, DIY projects, creative work, educational use and related activities.

Where applicable, our products are CE marked in accordance with EU requirements for toys and are tested or evaluated according to the relevant parts of the EN 71 toy safety standards and the EU Toy Safety Directive.

Some products may include small parts, tools, sharp edges, wood pieces, glue or other components that require careful handling.

Children should use our products only under the supervision of an adult, especially when using tools, glue, cutting equipment, sanding tools or small parts.

The customer is responsible for using the products safely and in accordance with the product instructions, safety information and age recommendations provided with the product.

Our products must not be misused, modified in an unsafe way or used for purposes other than their intended use. We are not responsible for damage or injury caused by improper use, failure to follow safety instructions or unauthorised modifications.

11. Customer content, reviews and photos

If you submit reviews, photos, videos, feedback or other content to us or through our website, you confirm that you have the necessary rights to do so and that the content does not infringe the rights of third parties.

Where you submit content for publication, for example product reviews, photo reviews or customer project images, you grant us the right to display, reproduce and use this content for the purpose of presenting customer feedback, promoting our products and operating our website and social media channels.

You remain the owner of your content.

We reserve the right not to publish or to remove content that is unlawful, offensive, misleading, inappropriate, infringes third-party rights or does not fit the purpose of our website.

12. Intellectual property

All content on our website, including texts, images, product photos, videos, logos, designs, product names, graphics, layouts, instructions and technical content, is protected by intellectual property rights.

You may not copy, reproduce, distribute, modify or use our content for commercial purposes without our prior written consent.

This does not affect mandatory legal rights or private, non-commercial use where legally permitted.

The purchase of a product does not transfer any intellectual property rights in our designs, brand, product concepts, molds, instructions, digital content or other protected materials.

13. Third-party links and services

Our website may contain links to third-party websites or services.

We are not responsible for the content, availability or practices of third-party websites. If you use third-party services, the terms and privacy policies of the respective provider apply.

14. Availability of the online store

We make reasonable efforts to keep our website and online store available and secure.

However, we do not guarantee uninterrupted availability of the website. Temporary interruptions may occur due to maintenance, technical issues, security updates or circumstances outside our control.

This does not affect any rights you may have under an existing purchase contract.

15. Liability

We are liable without limitation for damages resulting from injury to life, body or health, for damages caused intentionally or by gross negligence, and where liability is mandatory under applicable law.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

In such cases, our liability is limited to foreseeable and typical damages.

The above limitations do not affect your statutory rights as a consumer.

17. Changes to these Terms

We may update these Terms and Conditions from time to time.

The version available on our website at the time of your order applies to your purchase.

18. Governing law

These Terms and Conditions are governed by the laws of Germany.

If you are a consumer and have your habitual residence in another country, mandatory consumer protection laws of that country remain unaffected.

19. Dispute resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

20. Severability

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.

The statutory provisions shall apply in place of the invalid provision.
